West Virginia Accessory dwellings (SB 659, 2026, W. Va. Code 8-40): what it allows on a lot
Accessory dwellings (SB 659, 2026, W. Va. Code 8-40) is West Virginia law, and the official source is at code.wvlegislature.gov.
In force June 4, 2026. A municipality must allow an accessory dwelling by right, with no hearing or variance, on a parcel with a single family home, up to 75 percent of the house's floor area or 1,000 square feet, with no extra parking, no matching design rule and an application fee of no more than $250; a conflicting local rule is void from January 1, 2027. Counties are not covered.
Whether it applies to one lot turns on where the lot is and what it is zoned; the city, county or state office named in the law decides. Mapped areas are approximate. This is a plain reading of public law with its source, not legal advice.
