Texas SB 840 homes in commercial zones (2025): what it allows on a lot
SB 840 homes in commercial zones (2025) is Texas law, and the official source is at capitol.texas.gov.
In the same large cities, land zoned for office, commercial, retail, warehouse or mixed use may take apartments or mixed use buildings without a zoning change: the city may not hold them below 36 homes an acre or its highest residential density, below 45 feet or the height the commercial use gets, to a setback over 25 feet, or to more than one parking space a home (Local Gov. Code ch. 218). Heavy industrial land and land near airports and bases are out. In effect September 1, 2025.
Whether it applies to one lot turns on where the lot is and what it is zoned; the city, county or state office named in the law decides. Mapped areas are approximate. This is a plain reading of public law with its source, not legal advice.
